U.S. Court of Appeals Case No: 03-3364
and No: 03-3365
District of Minnesota
Criminal case - criminal law. Arresting officer had reasonable grounds
for conducting a Terry stop after observing what he believed to be drug
deals; officer had a grounds to conduct a pat down search and could seize
a wad of cash he touched in defendant's pocket as there was probable
cause to believe it was the evidence of drug dealing; officer had probable
cause to make arrest after finding the cash; co-defendant's absence from
trial did not prejudice defendant; testimony that defendant solicited a
witness to deal drugs was properly admitted; evidence was sufficient to
establish conspiracy and aiding and abetting possession with intent to
distribute; extraneous comment by court that seized meth would not be
sent back to the jury room because of its bad smell was inadvertent and
did not seriously affect the fairness and integrity of the trial process;
district court did not err in denying motion for a role-reduction.
