Applying Pirani's plain error analysis, defendant was entitled to Booker relief as the record as a whole suggests a reasonable probability that the defendant would have received a more favorable sentence but for the Booker error. 033379P.pdf 12/14/2004 USA v. Melroy Johnson U.S. Court of Appeals Case No: 03-3379 Northern District of Iowa
Criminal case - criminal law. The court lacks jurisdiction to review the chief judge's denial of a request for funds to obtain an expert under the Criminal Justice Act in excess of the maximum amount permissible under 18 U.S.C. Sec. 3006A(3)(2003); the chief judge's decision is an administrative decision which is neither a final decision for purposes of 28 U.S.C. Sec. 1291 nor an appealable interlocutory order for purposes of 28 U.S.C. Sec. 1292; the only way to seek review of the order is to file a request with the chief judge for reconsideration, and if that request is denied, the only possible remedy is to file a mandamus with the Supreme Court.
