Civil case - civil rights. Plaintiff, a Nebraska inmate discharged from
his prison job with TEK, failed to make a submissible case of
discriminatory discharge because he was not qualified for his position at
the time he was discharged; even if he could make a prima facie case, he
failed to show the stated reasons for the employment action were pretexts
for intentional discrimination; district court did not err in dismissing
hostile work environment claim as the work atmosphere at the prison was
not permeated with severe or pervasive harassment sufficient to alter the
terms and conditions of employment; claim under the Nebraska Fair
Employment Practices Act was properly dismissed.
