U.S. Court of Appeals Case No: 03-3469
District of Minnesota
Civil case - Rehabilitation Act. Medical student failed to present
sufficient evidence to show he was otherwise qualified to remain in the
medical school and was dismissed solely because of his disability; district
court did not err in finding no rational factfinder could conclude plaintiff
was dismissed solely because of his learning disabilities; based on the
uncontroverted evidence of plaintiff's academic and clinical deficiencies,
the only reasonable inference was that he was dismissed because of the
school's genuine concern that he could not synthesize clinical data;
plaintiff failed to present evidence showing more feedback or better
delivery of any other agreed accommodations would have cured his
deficiencies.
