Civil Case - civil rights. Court affirms the district court's determination
that Missouri's Adopt-A-Highway program's denial of Unit 188 of the
Knights of Ku Klux Klan of right to participate in AAH program was
unconstitutional. State is collaterally estopped from relitigating the
constitutionality of the discriminatory membership regulation. The State
did not prove Unit 188 had a history of violence and denial of right to
participate based on the use of the choice of name and conduct of others
infringes on expressive and associational rights. Further, the history of
violence regulation is unconstitutionally overbroad.
