Civil Case - civil rights. Following a collision between county sheriffs and driver of an all-terrain vehicle during a chase, district court granted summary judgment to sheriffs and county, concluding allegations of gross negligence were insufficient to satisfy a claim of substantive due process. Because injured driver must show an intent to harm in order to establish a violation of substantive due process and he made no allegation that officers acted with the requisite intent, district court's grant of summary judgment was proper.
