033695P.pdf 08/23/2004 Robert L. Dever v. Hentzen Coatings
U.S. Court of Appeals Case No: 03-3695
   Western District of Arkansas
Civil Case - diversity; personal jurisdiction. Dever, a resident of Kentucky, brought diversity product liability action in Arkansas against paint chemical producers, claiming he developed a brain tumor as a result of exposure to chemicals. District court's dismissal for lack of personal jurisdiction is affirmed as to three defendants who contended only de minimis contacts in Arkansas. As for W.M. Barr whose products are found in Arkansas in stream of commerce, there was insufficient showing of personal jurisdiction. District court erred in concluding Sherwin Williams, operator of retail stores in Arkansas, had insufficient contacts with state to satisfy due process. Because LHB and Hill did not contest personal jurisdiction, record shows sufficient contacts for exercise of personal jurisdiction.
