033710P.pdf 12/03/2004 Cynthia Schuhardt v. Washington Univ.
U.S. Court of Appeals Case No: 03-3710
   Eastern District of Missouri
Civil case - qui tam. District court did not err in dismissing qui tam action as there was not sufficient evidence of fraud to survive summary judgment; the court did not abuse its discretion in denying further discovery and properly evaluated the evidence and credibility issues; the court erred in granting the university summary judgment on plaintiff's claim she was retaliated against in violation of the Federal Whistleblower statute - 31 U.S.C. Sec. 3730(h); plaintiff presented sufficient evidence to show she was engaged in protected activity and that the university knew of such activity; case remanded for further proceedings on the retaliation claim.
