033808P.pdf 11/01/2004 United States v. Gerald Dean Janis
U.S. Court of Appeals Case No: 03-3808
   District of South Dakota
Criminal Case - criminal law. District court did not err in denying
motion to suppress, as court did not clearly err in finding consent to
search the house by adult in the house. Exigent circumstances justified
the search even if consent was not valid. Exclusion of defense expert
witness was not an abuse of discretion and any error was harmless. Court
did not err in admitting fingerprint expert. [PUBLISHED] [Riley,
Author, with M.Arnold and Fagg, Circuit Judges]
