033817P.pdf 05/14/2004 United States v. Terry L. Harlan
U.S. Court of Appeals Case No: 03-3817
District of Nebraska
Criminal case - Sentencing Guidelines. Evidence was sufficient to
support convictions for assault with a dangerous weapon and assault
resulting in serious bodily injury; District court did not err in concluding
defendant's criminal history category understated his criminal history and
inadequately addressed the severity of the victim's physical and
psychological injuries; district court could rely on federal manslaughter
conviction which was imposed outside the fifteen-year period prescribed
by Sec. 4A1.2(e)(1), based on its finding that the sentence was evidence
of similar criminal conduct.
