U.S. Court of Appeals Case No: 03-3836
District of Minnesota
Civil case - products liability. District court did not err in excluding
plaintiff's expert testimony on cause of fire on the basis that the
testimony was unreliable and potentially confusing to a jury; the
experimental testing on which the testimony was based did not meet
National Fire Protection Association standards for fire investigations;
alternative theory advanced by the experts was not supported by the
evidentiary record; even if the testimony was admissible, the district court
was correct in its alternative finding that the evidence failed to establish
that the supposed defect in the Canon copier was the proximate cause of
the fire.
