U.S. Court of Appeals Case No: 03-3876
Western District of Missouri
Criminal case - Sentencing Guidelines. District court did not err in
imposing enhancements for obstruction of justice and use of
sophisticated means, as the evidence showed defendant made materially
false statements to law enforcement officers to lead them astray and
conceal his assets and he used sophisticated means to execute his scheme
to defraud car dealers; case does not need to be remanded under Booker
as defendant failed to show a reasonable probability that the district court
would have imposed a lesser sentence absent the Booker error; district
court's use of the name Glenn Benton Finck instead of defendant's
claimed identity, Beau Lee DuBois, did not deny him due process.
