Petition for Review - immigration. Decision to deny application for cancellation of removal based on continuous physical presence is reversed. Whether an alien has complied with continuous physical presence requirement is nondiscretionary determination subject to review. Because alien's voluntary departure did not occur under threat of deportation or removal proceedings, his continuous physical presence was not interrupted.
