U.S. Court of Appeals Case No: 03-3993
   Eastern District of Missouri
Civil Case - antitrust. District court's denial of motion to certify two classes was not an abuse of discretion. In price-fixing conspiracy claim that seed companies conspired to inflate prices for genetically-modified corn and soybean seeds to support technology fees, two classes of farmers sought class certification. District court's conclusions that common questions did not predominate over individual questions and that the existence of the a conspiracy to fix prices and the existence of harm did not constitute common questions are affirmed. J. M Arnold concurs. [PUBLISHED] [Bright, Author, with M.Arnold and Beam, Circuit Judges]
