U.S. Court of Appeals Case No: 04-1039
Eastern District of Missouri
Civil case - contracts. In action for breach of franchise agreement,
evidence was sufficient to establish plaintiff's future lost profits with
reasonable certainty; no error in admitting the testimony of plaintiff's
damages expert; evidence was insufficient to support the jury verdict and
damages award for tortious interference with a business expectancy, as
there was no evidence to show defendant would have renewed plaintiff's
franchise after it expired in 2002.
