041178P.pdf 05/13/2005 United States v. Maurice E. Patterson
U.S. Court of Appeals Case No: 04-1178
   Eastern District of Missouri
Criminal Case - conviction. Evidence was sufficient to support conviction for possessing a firearm or ammunition. Model Jury Instruction on reasonable doubt did not violate due process and has been previously upheld. Sentencing defendant as an armed career criminal based on prior convictions for violent felony is not plain error. In light of district court's statements regarding seriousness of prior offenses, there is no reasonable probability that district court would have imposed a more favorable sentence but for the Booker error. Conviction and sentence are upheld. [PUBLISHED] [Bowman, Author, with Bye and Melloy, Circuit Judges]
