U.S. Court of Appeals Case No: 04-1200
   District of Minnesota
Civil case - contracts. District court did not err in finding plaintiff had failed to satisfy the contractual condition precedent to litigation because it had not given written notice of its breach of contract claims to the project architect; failure to provide the written notice also precluded plaintiff's assertions of negligence against the City of East Grand Forks; project manager acted within the scope of the contracts and incurred no additional obligation to plaintiff when it required verification of plaintiff's work; there was no evidence project manager played any role in furnishing plans or had any duty to verify blueprints, and plaintiff could not state a negligence claim for providing inaccurate plans.
