U.S. Court of Appeals Case No: 04-1293
Northern District of Iowa
[PUBLISHED] [Gruender, Author, with Colloton and Lay]
Criminal case - Criminal case . Evidence was sufficient to support drug
convictions; Amendment 640 to the guidelines, which enacted a
mitigating-role cap for offenses involving actual controlled substances
but not methamphetamine precursors, did not amount to a denial of
substantive due process or equal protection; applying Pirani's plain error
analysis, defendant was not entitled to Booker relief as she failed to
demonstrate a reasonable probability that the district court would have
imposed a lesser sentence under an advisory guidelines scheme. Judge
Lay, concurring.
