U.S. Court of Appeals Case No: 04-1444
Southern District of Iowa
Civil case - civil rights. District court did not err in finding defendant
police officers had probable cause to arrest plaintiff; under Eighth Circuit
law, in order for a plaintiff to prevail on a Section 1983 due process
claim, he must show the defendants acted in bad faith and since plaintiff
concedes he has no evidence of bad faith or malice on the officers' part,
his due process claim fails.
