U.S. Court of Appeals Case No: 04-1525
District of Minnesota
[PUBLISHED] [Wollman, Author, with Bye and Colloton, Circuit
Judges]
Criminal case - Sentencing Guidelines. District court did not err in
imposing an enhancement for amount of loss as defendant did not
challenge the total amount lost in the fraud; applying Pirani's plain error
analysis, defendant was not entitled to Booker relief, as the district
court's comments at sentencing showed that the court would not have
imposed a lesser sentence under an advisory guidelines scheme.
