U.S. Court of Appeals Case No: 04-1532
Eastern District of Arkansas
Habeas Corpus - sufficiency of evidence. Grant of habeas relief based
on lack of sufficient evidence to support rape conviction is reversed, as
circumstantial evidence present was sufficient for any reasonable juror to
find defendant guilty beyond a reasonable doubt. Due process rights were
not violated by state court's reliance on prior sexual abuse as evidence
supporting conviction. Decision of state supreme court was not an
unreasonable application of clearly established federal law. Dissent by J.
Bright. [PUBLISHED] [Bowman, Author, with Bright and Melloy,
Circuit Judges]
