U.S. Court of Appeals Case No: 04-1639
Southern District of Iowa
[PUBLISHED] [Benton, Author, with Smith and Lay, Circuit Judges]
Criminal case - criminal law. District court did not err in giving an
Allen charge after jury had deliberated for 11 hours; evidence was
sufficient to support conviction for attempting to manufacture
methamphetamine and creating substantial harm while attempting to
manufacture the drug; applying Pirani's plain error analysis, defendant
was not entitled to Booker relief as he had failed to demonstrate a
reasonable probability that the district court would have imposed a lesser
sentence under an advisory guidelines range; record did not support
defendant's claim for a minor or minimal role reduction.
