U.S. Court of Appeals Case No: 04-1668
Eastern District of Missouri
Civil Case - civil rights. Parents alleged violations of procedural due
process and failure to train against school district arising from 10-day
suspension to student cheerleaders for consuming alcohol before school
football event. Grant of summary judgment to school district is affirmed,
as evidence showed teacher training was adequate and parents failed to
show deliberate indifference. Students received all the process that was
due; right to counsel was not implicated; and administrator was not
unconstitutionally biased . Judge John R. Gibson concurs in result.
