district court erred in denying motion for summary judgment based on
qualified immunity as the issue was based on what facts could be proven
at trial, and such fact-based claims are not subject to review at this stage
of the proceedings; however, two defendants should have been granted
summary judgment as plaintiff has admitted they played no part in his
demotion.
