U.S. Court of Appeals Case No: 04-1807
District of Minnesota
Criminal Case - sentencing. District court did not err in denying
motion to suppress statement, as statement was not a result of an
interrogation even though defendant was in custody and was otherwise
harmless error; deferral of ruling on admissibility of prior guilty plea was
harmless because defendant did not testify; exclusion of witness
testimony was harmless. Challenge to sentencing enhancement for
leadership and obstruction of justice are reviewed for plain error.
Defendant did not demonstrate reasonable probability that district court
would have given more favorable treatment in light of decision to give
concurrent rather than consecutive sentences.
