U.S. Court of Appeals Case No: 04-1827
Northern District of Iowa
Criminal case - Sentencing Guidelines. Defendant's Iowa conviction,
while expunged, still counted under the Guidelines as it was not
expunged due to constitutional invalidity, innocence, or a mistake of law;
district court did not err in imposing a two-level enhancement for
obstruction of justice based on defendant's failure to appear; defendant
failed to show the district court would have imposed a lesser sentence
under an advisory guidelines scheme and was not entitled to Booker relief
under Pirani.
