U.S. Court of Appeals Case No: 04-1899
Eastern District of Missouri
[PUBLISHED] [Smith, Author, with Melloy and Colloton, Circuit
Judges]
Criminal case - criminal law. In prosecution for felon in possession of
a firearm, the District court properly limited testimony concerning the
murder defendant committed with the handgun in question to only what
was necessary to prove his possession of the weapon; applying Pirani's
plain error analysis, defendant was not entitled to Booker relief as he
failed to demonstrate a reasonable probability that the district court would
have imposed a lesser sentence under an advisory guidelines scheme.
