U.S. Court of Appeals Case No: 04-1967
Eastern District of Missouri
[PUBLISHED] [Bye, Author, with Loken, Chief Judge, and Fagg,
Circuit Judge]
Civil case - insurance. Evidence was sufficient to support jury's finding
that insurance agent was acting as insurance company's agent at the time
he completed and transmitted an application for insurance, and his
knowledge can be imputed to the insurer; evidence established insureds'
son was acting as their agent when he obtained the insurance, and their
interests in the property are reflected in the policy; case remanded with
directions to reinstate the jury verdict.
