U.S. Court of Appeals Case No: 04-2023
District of Nebraska
[PUBLISHED] [Gruender, Author, with Riley and John Gibson, Circuit
Judges]
Criminal case - Sentencing Guidelines. Evidence established
possession of firearm during the course of relevant conduct, and the
district court did not err in imposing a dangerous weapon enhancement
under Guidelines Sec. 2D1.1(b)(1); applying Pirani's plain error analysis,
defendant was not entitled to Booker relief as he failed to show a
reasonable probability that the district court would have imposed a lesser
sentence under an advisory guidelines scheme.
