U.S. Court of Appeals Case No: 04-2066
District of South Dakota
Civil Case - Indian law. Crow Creek Sioux Tribe members lack
standing to sue individuals and government for the Tribe's misuse of
money paid under the Crow Creek Sioux Tribe Infrastructure
Development Trust Fund Act because the requested relief will not cure
the alleged injury. Rescission of bond order will not likely remedy
alleged harm; the Act does not empower the government to control the
Tribe's spending; the Act does not create an actionable fiduciary duty on
the part of the government, and Tribe is not a party to the action.
