Criminal Case - criminal law. District court's grant of specific
performance of signed plea agreement, withdrawn by the government
before acceptance of the guilty plea by the district court, is
reversed. Due process rights do not attach and detrimental reliance
theory does not apply until district court accepts plea. Government
may not use prior admissions to gain unfair advantage in future
proceedings and pre-plea performance agreements may be specifically
enforced before acceptance by the district court. Judges Colloton
and Murphy concur in judgment. Judges Bright, Bye, Melloy, and
Benton, dissent.
