Criminal case - criminal law. District court did not abuse its discretion
in determining the dismissal of indictment for violation of defendant's
right to a speedy trial under the Interstate Agreement on Detainers Act
should be without prejudice; district court properly considered the three
relevant factors - seriousness of offense, facts leading to the dismissal and
impact of re-prosecution on the administration of the Act and on the
administration of justice - in determining re-prosecution should be
permitted.
