Criminal case - Sentencing Guidelines. For the court's earlier opinion
in the case, see U.S. v. Coffey, 395 F.3d 856 (8th Cir. 2005). On remand
from the court en banc for further consideration in light of Pirani, the
panel concludes defendant is not entitled to Booker relief as the record
does not demonstrate a reasonable probability that defendant would have
received a lesser sentence under an advisory guidelines scheme. Judge
Heaney, concurring.
