U.S. Court of Appeals Case No: 04-2209
Southern District of Iowa
Criminal Case - conviction. Convictions for conspiracy to distribute
and attempt to possess methamphetamine are affirmed. District court did
not err in denying suppression motion as district court did not clearly err
in finding defendant's common law wife voluntarily consented to search
the resident after reviewing totality of circumstances and according strong
weight to district court's credibility determinations. Government's strike
of sole minority on jury panel was based on her social work type-
employment and long fingernails demonstrating her liberal nature; district
court did not clearly err in finding no purposeful racial discrimination.
