U.S. Court of Appeals Case No: 04-2336
Northern District of Iowa
[PUBLISHED] [Bye, Author, with Hansen and Gruender, Circuit
Judges]
Criminal case - Sentencing Guidelines. District court did not err in
imposing a four-level enhancement for possession of a firearm in
connection with another felony offense under Guidelines Sec.
2K2.1(b)(5); applying Pirani's plain error analysis, defendant was not
entitled to Booker relief as he failed to demonstrate a reasonable
probability that the district court would have imposed a lesser sentence
under an advisory guidelines scheme.
