Civil case - employment discrimination. Employer was entitled to
summary judgment on claim plaintiff's termination violated her rights
under the Age Discrimination in Employment Act as plaintiff failed to
create a factual dispute that the employer based her termination upon the
prohibited motive of age; the district court did err in granting summary
judgment to the employer on plaintiff's claim that the employer retaliated
against her for asserting a discrimination claim as the evidence was
sufficient to create a factual dispute as to whether she was fired for filing
the claim. Judge Colloton, concurring in part and dissenting in part.
