U.S. Court of Appeals Case No: 04-2409
and No: 04-3239
District of Minnesota
[PUBLISHED] [Colloton, Author, with Wollman and Bye, Circuit Judges]
Civil case - ERISA. District court erred in finding that the decision to
deny benefits was founded on a serious procedural irregularity in the
claim review process; as a result, the decision to deny benefits should
have been reviewed under the abuse of discretion standard; applying that
standard, it was not unreasonable for the plan administrator to deny
benefits based upon a lack of objective evidence. Judge Bye, dissenting.
