U.S. Court of Appeals Case No: 04-2429
District of South Dakota
[PUBLISHED] [Gruender, Author, with M. Arnold and Bowman,
Circuit Judges]
Civil case - civil rights. District court did not err in finding defendant
sheriff was entitled to qualified immunity on claim that he used excess
force to block plaintiff's movements during a sentencing proceeding
involving her son, a dangerous and violent offender; stopping plaintiff
from coming closer to her son was a reasonable means of furthering
courtroom safety, and the amount of force used could not be excessive in
light of the de minimis nature of plaintiff's alleged injuries.
