[PUBLISHED] [Wollman, Author, with Bright and Bye, Circuit Judges' Criminal case - Sentencing Guidelines. Facts in the Presentence Report, which were admitted for Booker purposes, justified the district court's imposition of enhancements for restraint of a victim and sanctioning of violence; no error in imposing an enhancement for brandishing a weapon; applying Pirani's plain error analysis to the district court's imposition of an enhancement for obstruction of justice, the defendant is not entitled to Booker relief as he could not demonstrate that he was prejudiced by the enhancement; district court properly calculated 25% reduction for substantial assistance. Judge Bright, Dissenting.
