U.S. Court of Appeals Case No: 04-2463
Eastern District of Missouri
[PUBLISHED] [Bowman, Author, with M. Arnold and Riley, Circuit Judges]
Criminal case - criminal law. District court did not abuse its discretion
in limiting cross-examination of an FBI agent and a government witness
concerning witness's warrant on pending state charges; applying Pirani's
plain error analysis, defendant was not entitled to Booker relief as he
could not demonstrate a reasonable probability that the district court
would have imposed a lesser sentence under an advisory guidelines
scheme.
