U.S. Court of Appeals Case No: 04-2469
Southern District of Iowa
[PUBLISHED] [Riley, Author, with Loken, Chief Judge, and M.
Arnold, Circuit Judge]
Criminal case - criminal law. Evidence was sufficient to support
conviction for being a felon in possession of a firearm; admission of
testimony concerning drugs found near firearm was not error; applying
Pirani's plain error analysis, defendant was not entitled to Booker relief
as he failed to demonstrate a reasonable probability that the district court
would have imposed a lesser sentence under an advisory guidelines
scheme.
