Civil Case - patent infringement. Eighth Circuit has jurisdiction over
patent issue raised for first time in counterclaim. Patent invalidity claim
is remanded for the district court to conduct a claim construction analysis.
District court did not err in finding inventor did not engage in inequitable
conduct. District court abused its discretion in denying motion to amend
judgment because Mid-State is entitled to declaratory judgment on non-
infringement, as inventor is barred from bringing a future infringement
action. Breach of license agreement claim is remanded, as it is related to
the patent invalidity claim.
