U.S. Court of Appeals Case No: 04-2595
District of South Dakota
Criminal Case - suppression. Tribal police officers did not act in
excess of their authority by seizing defendant, who is not an Indian, and
did not violate the Constitution by searching the vehicle. The district
court did not err in denying a motion to suppress statements he made after
he was given his Miranda warnings and his earlier unwarned statement
was not the result of coercion or threatening tactics. [PUBLISHED] [M.
