U.S. Court of Appeals Case No: 04-2603
District of Minnesota
[PUBLISHED] [Gruender, Author, with Murphy and Bright, Circuit Judges]
Civil Case - civil rights. District court's reduction of jury award of
$75,000 in nominal damages to one dollar for use of excessive force
during pretrial detention is affirmed, as district court did not exercise its
discretion to reduce award but reduced the award as a matter of law based
on jury finding that use of force was not a direct cause of injury. District
court did not err in not offering a choice between a new trial and
reduction in award, as reduction was not a remittitur. Dissent by Judge
Bright.
