Criminal case - Sentencing Guidelines. Prosecutor's argument that
defendant's factual stipulations supported felonious assault, prior to any
request by the court for such information, was essentially an argument
that the court should apply Section 2K2.1(c)(1), as opposed to Section
2K2.1(a), and violated the plea agreement between the parties which
stipulated that Section 2K2.1(a) was the applicable guideline; case
remanded for resentencing.
