U.S. Court of Appeals Case No: 04-2702
Western District of Missouri
[PUBLISHED] [Melloy, Author, with Colloton and Gruender, Circuit
Judges]
Civil case - civil rights. Defendants' actions in holding plaintiff for the
purpose of performing a psychiatric evaluation pursuant to the provisions
of Mo. Rev. Stat. 632.305 were authorized by law, were objectively
reasonable, and did not involve the use of excessive force, and the district
court did not err in granting defendants' motion for summary judgment
on plaintiff's claims of unreasonable seizure and excessive force.
