U.S. Court of Appeals Case No: 04-2724
District of South Dakota
Criminal case - criminal law. District court erred in suppressing
evidence obtained after an officer of the Rosebud Sioux Tribal Police
entered defendant's home without a warrant; evidence was admissible
because exigent circumstances justified the officer's entry and because
defendant committed a new and distinct crime after the officer entered the
home.
