U.S. Court of Appeals Case No: 04-2799
Western District of Arkansas
[PUBLISHED] [Gruender, Author, with Riley and Bowman, Circuit
Judges]
Prisoner case - prisoner civil rights. Three of the claims raised in
defendants' appeal of an order denying their motion for summary
judgment based on qualified immunity could not be considered on appeal
because the issues involve questions of evidentiary sufficiency; with
respect to the final issue, the court could not say as a matter of law that
defendants were not deliberately indifferent in responding to plaintiff's
miscarriage, and the district court did not err in denying their motion for
summary judgment on the claim.
