U.S. Court of Appeals Case No: 04-2809
Western District of Arkansas
[PUBLISHED] [Bowman, Author, with Riley and Gruender, Circuit
Judges]
Civil case - employment discrimination. District court did not err in
granting summary judgment for employer on claim plaintiff had suffered
retaliation as a result of filing an EEOC complaint, as plaintiff failed to
show a causal link between the complaint and his discharge during a RIF;
even if plaintiff could establish a prima facie case of retaliation, he
failed to show the stated legitimate and non-retaliatory reason for his
discharge was a pretext for retaliatory motive.
