U.S. Court of Appeals Case No: 04-2810
District of South Dakota
Civil case - employment. There was sufficient evidence for the jury to
find that plaintiff's Americans with Disabilities Act claim was not
inconsistent with his application for Social Security disability benefits;
jury's award of actual damages for failure to accommodate must be set
aside as there was no evidence that plaintiff suffered any actual damages
from employer's failure to accommodate; plaintiff was not entitled to an
award of front pay as he could not have been reinstated because the jury
found that he would not have been working for defendant regardless of
his disability.
